   9. If a college is unable to satisfy us that funds for 2004-05 and 2005-06 were used for the purposes intended, we may seek to reclaim the funding provided.
   
   10. For 2006-07 and 2007-08, provided that the planned capital expenditure supports the college's HE strategy and that the eligibility requirements are met, we will pay these funds from October 2006.
