The TSLO informed Members that Mr. Noel McNulty, due to illness could not attend but that Mr. Maurice & Thomas McNulty together with their Solicitor, Mr. John Fahy would be making a presentation on behalf of the above site and the original written submission was on the last page of the report.

The Chairman welcomed Mr. Maurice and Mr. Thomas McNulty and their Solicitor, Mr. Fahy to the Meeting and explained to them the format for the Meeting.

Mr. Fahy on behalf of Mr. McNulty applauded the proposed new legislation and said it would be good to have the trading monitored and controlled.

Mr. Fahy said that he believed the objections from the PSNI and DRD were standard forms of objection and he had requested a copy of the report upon which they were based.He said it was difficult to deal with the issues on behalf of his client without having full sight of the report or comments on which the objections were based.He said it would be unfair for Council to decide upon sites without looking at all the evidence and then making an informed decision.
Councillor McNulty welcomed Mr. Fahy and his clients and said that as Councillors they had been presented with objections from DRD and PSNI but had not been given any evidence to back up the objections.He said that the Council's Solicitor had recommended that Council should not override the objections and as a Councillor he did not know what to do.
The Chairman said that the legal opinion received was a general one and not specific to any particular site.
Mr. Fahy said that the objections listed were repeated time and again and before making any decision Council would require sight of the evidence upon which the objections were made.He said that over the years of trading by Mr. McNulty he had seen a lot of blockages on the Bridge but had never received any complaints from any Statutory Agency or motorist.
Councillor McMenamin asked if Mr. McNulty was aware of an alternative site and in response Mr. Fahy said this had not been considered by his client.

The Chairman thanked Mr. Fahy and his clients for attending the Meeting and said that Council would discuss the issue at a subsequent meeting and they would be kept informed.
