They are not supposed to leave the doctor unless another doctor assumes the practice by purchasing it, or having it gifted to them, Eisen says. He says even if a patient leaves a doctor, the original files stay with the doctor, and partial or full copies are passed onto the new doctor. "The physical original copy must remain with the doctor," Eisen says. "The doctor must retain the original records." Although the records themselves are the legal property of the doctor, "the information in them is the legal entitlement of the patient," Eisen says. He says for a patient to get the information for themselves, legal or insurance reasons, or for another doctor, they must sign a release to the physician or the physician's agent. "We act as a legal custodian," says Eisen about the storage service. He says there have been a lot of calls from Higgs' former patients. Eisen also says the public can become more proactive in their health care. He says patients can get and keep a copy of their medical files. Doctors can also summarize the files for a fee. Clients left without a family doctor and have to go to walk in clinics should have a copy so they don't have to pay for or have trouble accessing their files, he says. "We encourage this so they don't have to go through this again," Eisen says. -
