    "They're essentially trying to legislate something that's already happening on its own," said John Dupuy, owner of the downtown Ninth Street Deli.He noted that more than 50 Columbia eateries are smoke-free by choice - including his own.

    Dupuy, who converted the venerable deli into a smoke-free restaurant after purchasing the business three years ago, called the effort to reduce smoking, second-hand or otherwise, "a laudable goal."

    He just doesn't want the heavy hand of government telling individual property owners how to run their businesses.Or telling smokers what to put into their bodies.

    "It all comes down to, can we as individual citizens make bad health decisions," said Dupuy, a founding member of the Boone Liberty Coalition, formed earlier this year when the latest anti-smoking proposal first surfaced.

    Coalition member John Dupuy said this would leave a small niche market that would cater to the smoking population.He said the figure makes sense because roughly 80 percent of Columbia residents don't smoke.

    "It's reasonable to assume that, given enough time and enough public awareness, most restaurants will become nonsmoking," Dupuy said.He said that if the trend doesn't continue in the next few years, the City Council would always have the option of looking at the issue again.

    Dupuy said restaurant workers would not be affected because as nonsmoking restaurants increase, it would be harder to find a job at a restaurant that allows smoking.He also said many restaurant workers jump from job to job anyway.

    Dupuy said a ban could cause unintended consequences.He said some places such as Grand Cru Restaurant, which offers a humidor but makes less than 50 percent of its revenue from tobacco sales, would be hurt.

    "While there may not be an overall economic effect, it would affect businesses that cater to the niche market," he said.

    John Dupuy says health is not the central issue in a push to ban smoking in Columbia restaurants and bars.After all, he says, there are plenty of eateries and taverns that already ban smoking.

    'People already have a choice in Columbia,' Dupuy said. 'This law isn't about safety.It's about choice and freedom.'

    That's why Dupuy and some of his friends have formed the Boone Liberty Coalition, or BLC, as an advocate for personal liberties and economic freedom in Boone County.Ironically, Dupuy is owner of Ninth Street Deli, which is smoke-free except on its outdoor patio.

    'The trend right now is for restaurants to go nonsmoking,' he said. 'There are roughly 100 restaurants in Columbia that are nonsmoking, so people here already have a choice.No one is being forced to breathe in secondhand smoke.'

    Dupuy says restaurants and bars are private property and thus owners should be allowed to tailor the atmosphere to what they believe appeals to their customers.

    'This isn't public property, which makes it different from other smoking ordinances in town,' he said.

    Dupuy said his group has about six members but is actively recruiting new members.

    As part of the group's 'Stop-the-Ban' campaign, Dupuy said flyers are being sent to local restaurants and bars, encouraging owners to make their views about the issue public.

    He also is asking people to visit the group's Web site, booneliberty.org.
