    In a few short years the Internet has not only proven itself to be an effective marketing medium for residential mortgage brokers and lenders, but also an effective product distribution channel.Unlike television, radio or other marketing media, the Internet has evolved into an interactive medium through which not only traditional marketing activities can be conducted, but direct communications made (in lieu, for example, of personal or telephone communications), specific leads created and referred, and transactions actually opened and processed.This aspect of the Internet, and the business-to-business relationships developing thereon, invite (if not compel) scrutiny as to compliance with Section 8 of RESPA (the acronym for the federal Real Estate Settlement Procedures Act).The potential for compliance scrutiny is enhanced by the fact that, unlike other media, many Internet sites through which marketing is conducted may be owned and operated by other settlement service providers in a unique position to refer business.In that context, economic relationships between mortgage lenders, mortgage brokers, and sites which may be characterized as business referrers may be scrutinized for financial dealings reflective of a referral fee arrangement violative of Section 8.
