    Among the issues expected to come to a head is the continued membership of Icosa president Jeffrey Donson, whose conviction for statutory rape was confirmed by the Cape High Court last week.

    Donson, a former mayor of Kannaland, was initially sentenced to serve a jail term for having sex with a 15-year-old girl, but the High Court revised the sentence on appeal to one of correctional supervision.

    The ruling makes it legally possible for Donson to serve as an elected official, but Icosa‘s constitution prohibits anyone convicted of rape from continuing as a member, according to Icosa Western Cape chairman Andrew Lyon.

    Child sex offender Jeffrey Donson is back on the council of the Southern Cape's Kannaland municipality after romping to victory in a by-election.

    The Independent Electoral Commission said on Thursday that Donson took 57 percent of the votes in Wednesday's poll, against the 37 percent of the second-placed African National Congress.

    Donson is president of the Independent Civic Organisation of SA.

    Three weeks ago the Cape High Court rejected his appeal against conviction on one count of indecent assault and seven of statutory rape, following an affair with a 15-year-old girl while he was Kannaland mayor.

    The offences were committed in 2004, when Donson was 42 and a married father of three, and he was convicted in January this year.

    Donson lost the mayoral post and his council seat in September when he was expelled from Badih Chaaban's National People's Party.

    At that stage he had dual Icosa and NPP membership, and was in council on an NPP ticket. The NPP (four seats) currently controls the nine-member council, which has its seat in Ladismith, in coalition with the ANC (one seat).

    Before Donson was elected mayor, he was found guilty in the Ladismith magistrate's court of indecent assault while working as a physical education trainer at the local high school.

    KANNALAND mayor Jeffrey Donson, president of the Independent Civics Organisation of South Africa (Icosa), will have to wait until Friday before being sentenced for the statutory rape and indecent assault of a teenage girl in Ladismith.

    Donson, who was scheduled to have been sentenced in the Oudtshoorn regional court yesterday, had his case postponed until Friday because neither he nor his lawyer Gideon Badenhorst were able to attend.

    Donson was convicted of indecently assaulting and having sex with a 15-year-old girl in 2004 when he also served a term as mayor of Kannaland.

    Some of the incidents took place in his mayoral offices in the Ladismith town hall.

    FORMER Kannaland mayor Jeffrey Donson has vowed to reclaim his council seat in a by-election at the end of this month, despite his failure last week to overturn the statutory rape conviction imposed on him earlier this year for having sex with an under-age girl.

    On Friday, the Cape High Court turned down Donson‘s appeal against convictions of indecent assault and statutory rape for having sex with a 15-year-old girl on seven occasions during his term in office.The court did, however, revise his jail sentence to one of correctional supervision, allowing him to stand for re-election.

    In February, Oudtshoorn regional magistrate Daniel Boks sentenced Donson to 18 months in jail for indecent assault, 12 months of which was conditionally suspended for five years, and to five years‘ imprisonment for statutory rape.

    Donson was also ordered to pay a R20000 fine and has to complete a rehabilitation programme for sexual offenders.

    Boks said in his judgment that Donson should have known better.

    FORMER Kannaland (Ladismith) mayor Jeffrey Donson received a letter yesterday saying he was no longer a council member as of September 3, but the municipality has decided to keep him on until an official bulletin in the Government Gazette later this month.

    According to municipal manager Kenny de Lange, Donson, who won his ward on a New People‘s Party ticket, ceased to be a councillor when he was dismissed from the NPP for refusing to give up his membership of the Independent Civics Organisation.

    Donson met NPP leader Badih Chaaban last week to discuss his dual membership and later faced a vote of no-confidence in the Dysselsdorp council, where he was relieved of his post as mayor and dismissed from the NPP.

    Donson, who is appealing his conviction on a statutory rape charge, said he was not there to make the council ungovernable."I am not here to fight with the council.I am sitting here as I am a councillor," he said.

    The speaker ruled that the council would wait for the announcement in the gazette and until then Donson could take part in council discussions.
