    Defendant previously convicted of DWI, was charged with DWI under Philomena's Law - enhanced penalties for DWI in a school zone.Court sentenced him to enhanced penalties as a second offender under Philomena's law, not under regular DWI statute, even though his convictions was his first under school zone section.

    Supreme Court ruled that the sentence was improper;unless his first conviction was for DWI in a school zone, he must be sentenced as a first DWI in a school zone offender.

    Donohue said Abendschoen was not interested in working with the government and therefore would not deviate from his claim of total innocence throughout the process.
