Doug Dillard, attorney for Terra Inc. and Capital Partners Development Inc., said the possibility of noise lawsuits was not an issue.

"I would submit that you can hear Road Atlanta from Chateau Elan, Mulberry Creek and Liberty Church Road," he said."How many lawsuits you had?"

Dillard also said claims the development would detract vendors were false.

"We're not trying to close Road Atlanta," he said."That's absurd."
