Mitchell McAllister, 20, of Brattleboro, was arrested for assault and robbery following an investigation, Officer Peter DiMarino of the Brattleboro Police Department said.

There were, however, more people involved in the incident, but many of them were juveniles and the investigation is still on going, DiMarino said Tuesday.

"It's very complex," Officer Peter DiMarino said of the nighttime crowds downtown.

Brattleboro Police officer Peter DiMarino served an arrest warrant on Vito J. Russo, 39, at approximately 6:32 p.m., reports state.

The protesters then told Brattleboro Police Officer Peter DiMarino their intention to stay put and transform the office into a "National Peace Office" for the day.

"Wardlaw was observed and videotaped leaving the store with a cart of groceries that were unpaid for," Brattleboro Police Officer Peter DiMarino stated in court documents.

"Wardlaw stated that he left the store not realizing that he had not paid for the groceries," DiMarino stated.

Brattleboro Police Officer Peter DiMarino said Jenkins was exhibiting mood swings, which persisted into tumultuous behavior.

Jenkins was placed under arrest for disorderly conduct and given a breath test, which revealed that his blood alcohol content was more than 0.31 percent, DiMarino said.

Two hours later, Jenkins was found on Elliot Street again, DiMarino said.

DiMarino placed Jenkins under arrest and brought him to Brattleboro Memorial Hospital to be medically cleared.

Once at the hospital, Jenkins became combative and tried to break out of the hospital room, DiMarino said.

Stabbing someone in the head is bad stuff," said Brattleboro police officer Peter DiMarino."We are still investigating this and the state's attorney may want to charge him with attempted murder."

DiMarino said the two men were involved in an argument that started in the bar.

There are other eyewitnesses that the police are waiting to investigate, DiMarino said.

"The State's Attorney may want to look closely at this," said DiMarino.

DiMarino said it did not appear that drugs were involved and he said both men were under the legal limit for blood-alcohol content.

"He was not arrested for driving drunk," DiMarino said about Howard, who was picked up in his car.

Howard was still in jail Sunday and is being held on $20,000 cash bail, DiMarino said.

Brattleboro Police Officer Peter Dimarino, the first officer to respond to the scene, testified that his conversations with the protesters was cordial and that he continued to suggest alternatives before the threat of arrest was introduced.

"I suggested they rent the empty space next (door) and open their own office there," he said.
