''The operation of the Virgo prior to the collision only can be characterized as gross negligence on the part of the crew on duty and the master of the ship , '' wrote John A. Cornett , assistant director of the Coast Guard Investigative Services , in the affidavit.
Cornett said the 541-foot Virgo is the only vessel still under scrutiny. Originally , 30 ships were identified as possibly being in the area of the accident.

Cornett testified in the affidavit that Marcantonio said the Starbound had activated its radar , but that an accompanying collision alarm had not been turned on.

''The ... tracking system identified the Virgo as the vessel closest to the site of the collision , '' Cornett stated. An urgent rescue transmission was sent via a required system , known to be on the Virgo , that produces a printed emergency message , Cornett said.
''The Coast Guard then attempted numerous times to directly contact the Virgo by radio and satellite phone'' from about 2 to 5 a.m. , the affidavit states. ''The Virgo did not respond to any of the attempts.''.
Cornett also said a Canadian marine safety inspector noted that the Virgo's logbook entries from midnight to 4 a.m. , Aug. 5 , ''were not of the same character , detail , or quality typical of the other watches.'' The tanker also was on autopilot during this time , Cornett said , compared with manual steering during the preceding and following watches.
Reacting to the arrests , Laura Mickelson , a longtime girlfriend of Frontiero's , said in Gloucester that the arrests confirm her suspicions about the Virgo.
