In a tense, exhaustive debate that lasted nearly two hours, New Castle County Council approved a resolution Tuesday that asks Council President Paul Clark not to handle land-use legislation because of an appearance of a conflict of interest.

Seven of the 13 council members agreed to the measure, which was drafted by Councilwoman Stephanie McClellan, D-5th District.The resolution does not have the effect of law, and Clark said he will not abide by it.
"I have done nothing but follow the rules of this council," Clark said, "Rules that were created before I arrived."
The request stems from controversy over an e-mail Clark sent last month to recipients in the business and development community.In the e-mail, Clark criticized the county's land-use process as too restrictive and asked for input on changes to laws regulating development.
Clark sent the message from his home computer and says he accidentally included an electronic tag from the law firm of his wife, Pamela Scott, a development attorney with the firm Saul Ewing.She was also one of the recipients.
The message has drawn fire from some residents who believe it shows Clark has a conflict of interest because of his wife.Several council members also have chastised Clark for the e-mail.
Tuesday's vote came after debate that touched on a myriad of loosely related topics and allegations.Councilman Penrose Hollins, who voted in favor of the resolution, accused Clark of having an associate go through Hollins' financial records in an attempt to start a retaliatory smear campaign.
Clark bristled at the accusation and said he had no part in it.He then voiced exasperation at rumors swirling about him.
"There must be a dozen of me because I'm with the union gang, I'm with the development community, I'm printing money for farmers," he said."I'm a guy who got elected who tries to represent everyone."
Clark also apologized for the e-mail.
"The only reason this resolution is presented tonight is because of my clumsiness with a computer," he said."But how many of you have pressed "send" and regret it.How many of you have not made some mistake.Many of you talk about civil rights and due process.Let's throw all that out and lynch Clark."
McClellan said her resolution was not meant to punish Clark or question his years of public service.She said she is responding to countless complaints from constituents about Clark's actions around the e-mail.
"Perhaps individually each of these factors may not have undermined the public's faith," she said.
