AN ODD TWIST IN THE DROSTE property saga occurred last week , when Pitkin County Assistant Planning Director Lance Clark announced that he would recuse himself as hearing officer for the hearing on whether the Droste family can build a multi-million-dollar road up the side of the hill in the Brush Creek Valley ( near Snowmass Village ) to get to their land near the top.
The hearing officer will decide whether to deny the application or to approve it with conditions. Clark has been the hearing officer for PitCo since 1994 , and has never recused himself before.
This time , he and PitCo Attorney John Ely decided that because it has been such a high profile case and there have been a number of staff discussions , it should be turned over to an independent third party hearing officer.
Typically , the hearing officer doesn't necessarily get involved in the strategy of making recommendations and coming up with a set of conditions , Clark said , noting that in this case , he had been involved in the staff talks.
Also , the county has two conservation easements abutting the land in question , and the Droste family has put PitCo on notice that they will appeal and go to court if their application is denied.
The independent hearing officer doesn't have to be a lawyer or a planner , but it would be nice if the person is familiar with the land-use code. The county intends to advertise for people who would be interested in the one-time-job.
The big question will be who , in their right mind , would take on such a task. -
