   Former Kenya Tourist Development Corporation (KTDC) Managing Director, Mr William Chelashaw, moved to the High Court yesterday challenging Sh50 million corruption charges mounted against him by the State.
   
   Chelashaw whose criminal trial is pending before the Nairobi Anti-Corruption Court wants a constitutional reference seeking termination, for good, of the corruption case that cost him his job.
   
   Defence lawyers Katwa Kipchumba Kigen and Julius Kemboy, representing Chelashaw, went before Criminal Division Vacation Judge, Lady Justice K H Rawal and obtained urgent certification of the constitutional application.

   Chelashaw is asking the constitutional court to grant him orders to prohibit the anti-graft court magistrate or any other magistrate from hearing the corruption case against him.
   
   He says his constitutional rights have been, are being and are likely to continue being violated unless restrained by the court.

   William Chelashaw
   
   He is a former Managing Director of Kenya Tourism Development Corporation and is facing abuse of office charges in relation to the collapsed Euro Bank. Chelashaw has denied arbitrarily investing Sh50m in the bank between June 19, 2000 and December 30 of the same year.
   
   His bid to have the charges in the case lodged in 2003 quashed was thwarted when a Constitutional Court dismissed it. He had argued that the case, which is currently pending before a magistrate's court, was an abuse of the court process.
