    Getting a power of attorney and changes to Medicaid are two things to consider for those with elderly parents, Midland attorney Mary Lou Cassidy told a gathering of Midland County Executive Women and their guests at the Petroleum Club Wednesday.

    New regulations, which went into effect in March, allow the state to put a lien against the homes of deceased Medicaid patients for reimbursement of expenses paid by the state -- with several exceptions.

    Cassidy, an attorney with the Stubbeman Law Firm, said if you were on Medicaid, or applied for it before March 1, it doesn't affect you.

    If there is a surviving spouse living in the residence, children under 21 living there or a disabled child in your family, the home cannot be taken, Cassidy said.

    Also, if there is an unmarried child living there who moved in a year before their parent moved into a nursing home, the home can't be taken, either. The assumption is they were taking care of their mother or father so they wouldn't have to go to a nursing home, she said.

    Hardship would also be created if the home is a working farm or ranch or taking the house forces someone on to Medicaid, she said.

    The house is vulnerable if it is worth more than $100,000 on the tax rolls. Also, if people living in the home are below poverty level it's a hardship, she said.

    To qualify for Medicaid, you must have assets, excluding one house and one car, of less than $2,000 and a monthly income of less than $1,700, Cassidy said.
