    John Cashman, an Old Town businessman and former Democratic state lawmaker who now serves as a senior policy adviser to the governor, told members of the panel the administration supported the bill's new language that clarifies the board's membership and duties.

    In an attempt to allay those concerns, Cashman said, the advisory board would serve as a public watchdog for the Greater Old Town community which was shaken in April by the news of G-P's plans to lay off half its work force and shut down a tissue paper machine. Rather than being an environmental issue, Cashman and other proponents maintained, the matter before the Legislature was largely economic.

    "We're trying to lower the cost of doing business at the G-P plant," he said. "So we told them that we will guarantee them capacity into the future [at the landfill] at a reduced tipping fee. Now that arrangement will be reflected in the price because anyone bidding on this is going to have to live with that, so it's going to lower the price that they're going to operate at. That's why it's difficult to say right now what the price will be."

    Cashman told the panel that in addition to providing an incentive to retain a major northern Maine employer, the state's acquisition of the landfill will provide new refuse capacity for the state. He estimated the two major landfill sites in Maine at Hampden and Norridgewock have a remaining working life of about six years. Cashman said the new proposed Old Town landfill could serve the state's needs for about 30 years.

    "Even if the mill weren't involved, this is a good deal for the state," he said. "The plain fact is that we produce waste and we have to deal with it. State law says the only [entity] that can run a commercial landfill now is the state. Either we're going to buy this one or we're going to be developing another one."

    The amended bill also clarified the limits of the state's liability for damages that could arise from any future litigation associated with the landfill's operation. Cashman said the state would not accept liability for materials buried at the facility before the state's acquisition of the landfill. That responsibility, he said, would remain with G-P or be assumed by the third party that submits the successful bid to operate the landfill.

    Rep. Joanne T. Twomey, D-Biddeford, repeatedly assailed the resolve's proponents for not spending enough time on safety considerations. A few years ago, Twomey led a campaign demanding greater accountability from the Maine Energy Recovery Co. that incinerates waste in her community. She was one of the two committee members who cast dissenting votes Wednesday.

    "I've dealt with the Department of Environmental Protection and I've dealt with toxic ash being spread in my community which they said was lime dust until I collected it to prove it was unacceptable levels of lead and dioxin," she said.

    "So I'm very skeptical about this proposal and I have a lot of concerns," she said.
