Chris Cashen of the Lexington office of Woodward, Hobson & Fulton, L.L.P., recently successfully argued a case in front of the Kentucky Supreme Court resulting in the Opinion Ostendorf v. Clark Equipment Company (located on Chris's bio on our website at www.whf-law.com).The case concerned a manufacturer's post sale duty to retrofit products with later developed safety devices.As a result of this decision, Kentucky joins a number of other states which do not impose such a duty on product manufacturers.
