SAN JOSE, Nov. 16 (IPS) -- Latin America has made advances in human rights in the past 30 years, but poverty, inadequate education and lack of opportunities are the chief violations of those rights today, said Antonio Cancado, president of the Inter-American Court on Human Rights.
With less than a week to go before the 30th anniversary of the Inter-American Convention on Human Rights, also known as the San Jose Pact, Cancado called for a shift in focus with respect to the question of human rights. Full story Related links -

The nature of the cases analyzed by this court is changing , said Brazilian Judge Antonio Cancado , president of the Inter-American Court , at the start of this year's first ordinary period of sessions.
In the 1980s and 1990s , most of the cases heard by the regional court involved violations of the right to life and personal freedoms , Cancado pointed out.
But as a regional pact on economic and social rights , signed in El Salvador in 1988 , begins to be ratified by countries in the region , the number of cases involving labor and economic rights is likely to increase , he added.
The San Jose-based Inter-American Court on Human Rights , along with the Inter-American Commission on Human Rights , are established by the American Convention on Human Rights.
The Commission , part of the Organization of American States ( OAS ) , has broad jurisdiction to investigate the situation of human rights in OAS member states , as well as specific cases that can be brought to it by individuals and non-governmental organizations.
The Commission can bring formal cases before the Inter-American Court , where it acts as a kind of prosecuting authority in suits involving rights violations for which damages or injunctions are sought.

According to Cancado , one of the most complex aspects of the case is that the former employees are suing a company that ceased to exist when it was privatized 10 years ago.
The representatives of the affected workers say the lawsuit will set a precedent on the impact of neoliberal measures and economic reforms aimed at beheading the unions and privatizing state companies..
Through Feb. 4 , the judges sitting on the Inter-American Court on Human Rights will deliberate on Baena Ricardo et al and four other cases. They are expected to hand down a sentence within a year.

The Panamanian state protested that Cancado compromised his impartiality by stating that the lawsuit was the first involving economic and social rights to be heard by the Court.
The representatives of the Panamanian state requested that the hearings be postponed , and called for Cancado's removal as president of the Court.
But the rest of the judges sitting on the Inter-American Court backed Cancado , and declared that his statements were not out of line.
