The hearing will take place in February in San Jose, Costa Rica, where the ICHR is headquartered. "Mexico has requested that the situation of immigrants be verified and studied in accordance with ICHR general guidelines," said Cancado, who is visiting Mexico City. On May 9, Mexico sent the ICHR a request for a "consultative opinion" to back the rights of Mexican workers in the United States.

"This is not about one specific case, it's about cases relative to the situation of immigrants," Cancado explained. The ICHR's ruling, however, will not be binding for the United States, which has not yet ratified the Inter-American Convention on Human Rights. Cancado calls the U.S. position "lamentable," adding that he believes the country owes a "historic debt" to the protection of human rights.
