(December 31) -- Homeowners insurance reform is a legislative priority for the Colorado Association of REALTORS® for 2004, according Dan Campo, political communications coordinator for CAR. At the beginning of 2003, CAR began collecting anecdotes from members about homebuyers who either couldn't get homeowners insurance or who found out after the sale closed that their insurance company wouldn't insure their new home. After reading through hundreds of such stories, the association's insurance task force drafted a six-point bill that would:
1. Require that insurance companies disclose more information to the Division of Insurance. "We want to know how insurers are using people's information," Campo says.
...
Although CAR hasn't come up with the specifics of how to deal with this issue, Campo says buyers shouldn't be told after closing that their property is uninsurable.
4. Let consumers obtain insurance scores, CLUE reports (reports that lists all insurance-related information on individuals and properties), and information on insurance company practices easily. Although buyers can acquire their CLUE report (for $15), the process is difficult and obscure, according to Campo. This part of the legislation would require insurance companies to send consumers their CLUE reports, first class, for free upon request.
5. Restrict what information insurance companies can use to analyze the insurability of a person or property. Currently, insurance companies can use any information they wish to determine the insurability of a person or property, Campo says.
6. Standardize what can be included in a CLUE report. Campo says many of the task force's anecdotes point to instances where people call their insurance company for clarification about coverage, and the insurance company records the inquiry in the same way it would a claim. -
