    Let's get two things straight -- big jackpot awards and settlements do not make the medical system safer, and insurance company investment losses have little to do with the rise in malpractice insurance rates.

    On the first point: Patient safety initiatives and studying medical errors will help to make the system safer.Big jackpots raise malpractice premiums and force doctors to make tough choices -- limiting services or closing their practices altogether.The end result is that patients are unable to get the care they need when they need it, which is much more dangerous and costly.

    Dr. Maureen Callaghan, president of the Washington State Medical Association, attacked citizen juries in her March 29 guest editorial "Dispelling myths of tort reform."It's a bit baffling considering that the vast majority of all requests for jury trials in medical negligence lawsuits come from doctors.

    Contrary to Dr. Callaghan's assertions, many objective sources do point to the stock market as the culprit for our current insurance crisis:

    Insurance industry data provided by the industry's largest source AM Best has shown that insurance premiums wax and wane with the stock market.

    Investing in bonds is not "virtually risk free" as Callaghan would suggest - especially when they are corporate bonds and interest rates are at an all-time low.

    Numerous reputable studies from consumer groups like Public Citizen, Foundation for Taxpayers and Consumer Rights and the Center for Justice and Democracy all point to insurance investment practices - not juries - as the culprits for the current self-inflicted insurance crisis.

    Insurance rates did not go down in the state of Washington when the Legislature adopted severe jury restrictions - they went up.

    California adopted insurance reform.Proposition 103 stabilized the insurance market by making insurance companies make a case for rate hikes.

    Dr. Callaghan did not mention that a recent study by Public Citizen ranked Washington 41st in the nation for its failure to discipline doctors' for medical negligence.This same consumer group found that only 5 percent of the doctors were responsible for more than 50 percent of the malpractice pay-outs.If medical discipline was meaningful, a large number of medical mistakes - and the consequences to patients - could be avoided.If current risk-management systems really work, then why haven't doctors reduced the malpractice?
