   Stephen Brownell, general counsel for the electric retail company AmPro Energy, said he thinks Houston's hometown energy company is the main one benefiting from the State Power Program.
   
   "This is just a backdoor government subsidy for a private power producer," he said.
   
   Through partnering with the land office, Reliant is not required to pay state taxes that other private utilities do. The energy company also has the state's credit to back it up.
   
   Brownell said he thinks that deal has helped Reliant get at least one contract it would have lost on its own - one with the city of Houston.

   But Brownell, an energy attorney for the last 20 years, said he thinks the land office is propping up what has become a financially unstable energy company.
   
   "All this is a subterfuge for Reliant to continue to compete in the state and not go under," Brownell said.

   "One of the biggest problems that Reliant faced in the city of Houston bid is that its credit rating is in the toilet," Brownell said.

   Brownell said he'd like to see a breakup between the gas supply and electricity marketing side of the power program. The most transparent method, he said, would be for the land office to sell its gas at auction and then buy electricity at auction on the other end.

   Brownell admits that competition drives some of his ire, but he says it is more than that. In his mind, the program as it is set up now defies some of the ideals of deregulation.
   
   "You want deregulation and right in the middle of it you have got a publicly owned body competing with an unfair advantage because they've got a subsidy," he said.
