Mr. Bretscher graduated Magna Cum Laude and Phi Beta Kappa from the University of Illinois, Urbana, with a B.S. in Physics. Mr. Bretscher subsequently earned his Master of Public Administration from Harvard University and his J.D. from George Washington University. He was a member of the George Washington Law Review, which published his note "The President And Judicial Review Under The Federal Records Acts," 60 Geo. Wash. Law Rev. 1477 (June 1992).
Mr. Bretscher has concentrated his legal practice on patent litigation, with a special focus on practice before the U.S. Court of Appeals for the Federal Circuit and the U.S. International Trade Commission. Before joining the firm, Mr. Bretscher worked in the Office of General Counsel in the U.S. International Trade Commission, where he represented the Commission before the Federal Circuit and provided analysis and recommendations on involving the importation of goods that allegedly infringed U.S. patents, in violation of section 337 of the Tariff Act, 19 U.S.C. § 1337. Mr. Bretscher has been involved in cases covering a wide range of technical matters, including ion trap mass spectrometers, rare-earth magnets, recombinant cells for drug testing, flash memory and other semiconductor devices, blood filters, cutting tools and various mechanical devices.
Mr. Bretscher earlier clerked for a U.S. magistrate judge and was a litigation associate in a general practice firm. He is a member of the bars for the District of Columbia and the State of Illinois, the U.S. Court of Appeals for the Federal Circuit, the U.S. District Courts for the District of Columbia, the U.S. District Court for the Northern District of Illinois and the District of Colorado. He is admitted to practice before the U.S. Patent and Trademark Office.
Before entering the legal profession, Mr. Bretscher spent eight years as a legislative and policy analyst. Mr. Bretscher worked for two and half years for a Illinois member of Congress, during which time he advised the Congressman on matters involving science and technology, foreign affairs, defense, the environment, and related issues. Mr. Bretscher subsequently worked for the National Science Foundation, where he advised the Director, Associate Directors, and other agency leaders on legislative matters impacting science, technology, science education, competitiveness, and the NSF budget. During his service with the NSF, Mr. Bretscher was detailed for one year to the White House Office of Science and Technology Policy, where he assisted with legislative and policy matters.
