    FERC Administrative Law Judge Lawrence Brenner approved the power contracts and ruled in favor of all the PSC's positions on issues affecting Arkansas ratepayers.

    Brenner rejected arguments by the Louisiana Public Service Commission, which said that benefits of the contracts should be assigned entirely to Entergy ratepayers in Louisiana and Texas.

    "(We) are please with Judge Brenner's decision and will not be appealing any of his rulings," the PSC said in a statement.

    Lawrence Brenner, an administrative law judge for the Federal Energy Regulatory Commission, ordered Entergy on Friday to more evenly divide its energy production costs among its regulated utilities.

    Brenner said Arkansas didn't pay enough of the other utilities' production costs, and Louisiana paid too much.

    Brenner chose not to put into place a system that automatically would keep production costs equal.He said such a remedy, called "full production cost equalization," would be severe.However, he did adopt a Louisiana suggestion that would create a "bandwidth" that indicates when costs are unequal.

    If an Entergy utility's production costs go below 7.5 percent of the entire system's average, it would have to pick up a higher share of the overall tab.If it goes above 7.5 percent, the utility would be entitled to a cost break.

    Entergy Corp. officials said in a prepared statement they were still concerned the administrative law judge inadvertently ordered something like full production cost equalization.

    Brenner also decided to spread the costs of a hydroelectric plant near Vidalia, La., which produces electricity at a significantly greater cost to Entergy Louisiana than some hydroelectric plants in Arkansas do for an electric cooperative.
