    Energy Law

    Mr. Bestor's energy practice focuses on litigation and government investigations and proceedings relating to electric utility deregulation and restructuring. Mr. Bestor represents clients in litigation matters in this area in federal and state courts in California and New England, as well as before the Federal Energy Regulatory Commission. He recently argued an appeal before the United States Court of Appeals for the Ninth Circuit on behalf of one of the world's largest energy companies. Mr. Bestor also represents energy clients in connection with proceedings initiated by various state and federal legislative, regulatory, and enforcement bodies.

    Mr. Bestor also represents clients in connection with electric industry restructuring. He represents and counsels market participants on issues relating to market design, market rules, the role of independent system operators and transcos, power exchanges, regional transmission organizations, market power and mitigation, reliability, capacity markets, congestion management, interconnection, and grid planning. Mr. Bestor has assisted clients in obtaining market-based rate authority, interpreting and negotiating reliability-must-run agreements, negotiating market power mitigation agreements, and other matters relating to participation in restructured energy markets. Mr. Bestor also advises clients on compliance with the Federal Energy Regulatory Commission's Order 2000 concerning regional transmission organizations.

    Complex Litigation

    Mr. Bestor has extensive trial and appellate experience both in government and at the Firm. Mr. Bestor has tried more than 50 jury cases and has argued more than 15 cases before the U.S. Courts of Appeal and several more before the District of Columbia Court of Appeals. Mr. Bestor also conducted over sixty grand jury investigations while a federal prosecutor, and in private practice he has represented witnesses before the grand jury and criminal defendants. In addition to the energy-related matters, Mr. Bestor has represented clients in matters involving, among other things, antitrust, securities, fraud, bribery, telecommunications, and computer-related issues.

    Mr. Bestor began his legal career in 1981 as an associate with Debevoise & Plimpton and joined Dickstein Shapiro in 1983. He was elevated to principal in 1987. From 1989 to 1997, Mr. Bestor served as an Assistant U.S. Attorney for the District of Columbia. In 1997, Mr. Bestor began serving as an Attorney-Advisor in the Office of Legal Counsel in the U.S. Department of Justice. In November 1997, Mr. Bestor was appointed Deputy Assistant Attorney General for the Office of Policy Development in the U.S. Department of Justice, in which position he served until his return to the Firm in June 1999.
