Paul Bertram, a local attorney and president of Marietta City Council, said if mediation fails, the core question before the Supreme Court will be whether it was proper for Badgett to bring the mandamus suit against the city.
"The ultimate question is, what if the municipal court conditions are so bad, but the government doesn't do anything about it?Can a citizen bring that action?"Bertram said."And the Supreme Court will have to decide whether the court of appeals judgment was legal, if that decision was appropriate and sound based on the law.
"If the court decides it was appropriate, you're bound by that (lower court) decision," he said
Bertram said he wants to know what the intervenors are trying to accomplish by taking the issue to the Supreme Court.
"Be careful what you ask for," he said.
