Eric Berry is a member of the Environmental & Regulatory Practice Group in the St. Louis, Missouri office of Husch & Eppenberger, LLC.
Eric has represented clients in numerous areas of environmental law, including transactional matters, such as real estate transfers, and compliance counseling.His primary area of experience has been in Superfund.He has negotiated administrative orders and consent decrees and formed and participated in PRP groups performing work pursuant to consent decrees.Eric has litigated contribution suits and liability defense suits.His litigation experience includes all stages of discovery, including expert discovery, briefing and oral arguments.In addition, Eric brought the first CERCLA § 106(b) action in which a petitioner received a final order granting reimbursement in full to a party who had received and complied with an EPA unilateral administrative order.
Eric was also successful, in Lake Environmental, Inc. v. The State of Illinois, 54 Ill. Ct. Cl.408 (2001), in recovering over $30,000 in attorneys' fees, under Illinois' Administrative Procedure Act, incurred in defending against an Illinois agency's Notice of Violation by proving that the agency's claims of noncompliance, found to be untrue, were made without reasonable cause.
