    The Monterey Peninsula Water Management District is considering an ordinance that would make it an infraction, punishable by a fine, to violate water conservation measures, said district general manager Dave Berger.

    The district has always had the authority to prosecute water wasters on criminal grounds, he said, but to do so requires going through a police department or the Monterey County Sheriff's Office and involving the District Attorney's office.

    Instead, he said, the district plans to hire a water education and enforcement officer who could respond to wastage complaints and work toward educating the public on the need for conservation.

    Compliance with conservation measures in the present Phase 1 conservation mode, Berger said, is voluntary and involves watering on specific weekdays based on addresses and avoiding using water to hose driveways or other similar uses.Larger landscaped properties must limit water use to established water budgets.

    If the district goes to Phase 2 or 3 because of a water shortage, he said, compliance will be mandatory and enforced.

    California American Water announced today that David A. Berger has been selected for the position of Manager, Coastal Water Supply Projects.Berger has served as General Manager of the Monterey Peninsula Water Management District since 2004.Berger will oversee all aspects of California American Water's on-going efforts to develop a permanent water supply solution for the Monterey Peninsula.

    In his new role, Berger will manage development of California American Water's proposed desalination facility located at Moss Landing, including coordination with local agencies that are analyzing a regional water solution program alternative, for consideration by the California Public Utilities Commission.He also will manage the company's project to comply with State seismic safety requirements that involves buttressing or elimination of the existing San Clemente Dam.

    Before coming to the Peninsula, Berger spent 27 years as a city manager in five California cities, where he gained extensive experience processing entitlements for major housing and commercial developments under federal and state environmental laws and myriad regulatory permitting requirements.He also oversaw the funding, design and construction of large-scale transportation, water and wastewater utility, and other public infrastructure projects.Berger also spent 5 years as Regional Business Manager/Vice President for the country's largest engineering and environmental services consulting firm, CH2M Hill.

    Berger holds a Bachelors Degree in Political Science from University of California, Santa Barbara, and a Masters Degree in Public Administration from California State University, Hayward.He is on the board of the Rotary Club of Monterey, and actively participates in local business and civic organizations.Berger resides on the Peninsula with his wife Donna.
