    Spokesman Frank Belluscio said that while state and federal laws rightly allow employees to takes leaves of absence, the court decision takes that idea too far, allowing for "an almost limitless leave and a perpetual right to reinstatement."

    "We feel the board should have the flexibility to fill a position with the most highly skilled or qualified individual," Belluscio said.

    He said the ruling could have the consequence of forcing districts to see tenure-charge cases through to the end instead of reaching deals that allow retirement in lieu of an outright firing. Given the difficulty and expense of firing tenured teachers, that will cost districts time and money, Belluscio said.

    There is no prescribed process for relocating students following an unplanned closing of a school for health and safety reasons said Frank Belluscio, spokesman for the New Jersey School Boards Association.

    Factors the school must consider include possible changes in transportation routing and employee contracts, he said.

    Belluscio was unaware of any emergency evacuations in the state due to dangerous levels of electromagnetic radiation. However, in 2004, the Deerfield Township School in Cumberland County unexpectedly closed for 21/2 years due to a mold problem.

    Those students were relocated to several neighboring school districts, and the school was later rebuilt Belluscio said.
