Mr. Baker said this is an Executive function and he does not feel the Council can stop construction on this project.

Mr. Baker said that as long as this is operating within budget it would be inappropriate to stop construction if funds were over expended then it would be a different situation, but he does not feel that stopping is an option as it would create a liability with the contractor.

Edgar A. Baker, Jr., County Attorney:
Bond Resolution - Mr. Baker said that the financial advisor has recommended a sale date of December 11, 2008 so the last date for adopting is November 18, 2008.
He said from since time the legislative bill was adopted Mrs. Petersen has identified funds from previous bond issues in which the projects are complete which the Charter allows to be applied to future Capital budget projects, thus the amount it will be necessary to fund from the sale of bonds will be $20,170,000, which is less than borrowing authorized in the Bond Legislation.
He also informed Council they could hold a special meeting for bond sale or authorize the Executive (within certain parameters) to accept the sale of the bonds.
Mr. Baker also said by recommendation of Mr. Ketterman if Council wanted to set parameters for Mr. Pollitt it would be 108% of par and true interest cost not to exceed 6.5%.

Mr. Baker said the vehicle has to meet either/or of the criteria to make it an abandoned vehicle.
This vehicle has been a Maryland Inspection Certificate.
Mrs. Prettyman feels that changes need to be made with possibly making one of the criteria to be if has been Maryland inspected.
President Cannon asked Mrs. Prettyman to let Mr. Creamer know when she was ready to have this placed on the agenda after working with Mr. Baker.
Mrs. Prettyman said that Mr. Baker can also work with County Executive and Code Enforcement.

Mr. Baker will check to see when a Resolution was passed adopting the one hundred dollar fee for a permit to sell the vehicle.
