Jim's practice concentrates on environmental, municipal and administrative law with extensive exposure to environmental approvals, environmental assessments, waste management, environmental compliance, environmental litigation and expropriation matters.He is also very much involved in the environmental due diligence aspects of corporate finance, securities, mergers, acquisitions and corporate restructuring.His expertise covers contaminated site issues and negotiations with regulators.His advice on environmental issues in commercial transactions is regularly sought by corporate clients with respect to the management of environmental risks, corporate governance, regulatory compliance, real property realizations and bankruptcies.Jim also advises residents, associations, municipal administrators and councillors on causes of action by and against municipalities including, but not limited to, by-law powers, prosecutions, municipal liability, conflict of interest and municipal elections matters.Most recently, Jim represented the Government of Ontario as part of the Smith Lyons' team at the Walkerton Inquiry.Jim's representation included Parts 1 and 2 of the Inquiry.Part 1 was Walkerton specific, whereas Part 2 consisting of expert panel meetings, public hearings and town hall meetings examined the broader issues and measures required to protect Ontario's drinking water in the future.Part 2 also examined such issues as the need to consolidate environmental laws pertaining to water, land use planning control of activities having the potential to affect surface and ground water, well head protection zones, constitutional, governance and other diverse issues.
Having obtained his law degree from the University of Windsor, Jim was called to the Ontario Bar in 1984.Jim served his articles with the Ministry of the Attorney General and also practised with that Ministry.He acted as counsel to the Ministry of Municipal Affairs and to the Niagara Escarpment Commission, and was a Deputy Director of Titles for the Real Property Registration Branch of the Ministry of Consumer and Commercial Relations.Jim practised with Smith Lyons LLP for eleven years before its merger with Gowlings in 2001.
