   Trevor Asserson is a Partner in the International law firm of Bird & Bird where he is joint head of the Litigation Department. Trevor graduated from Oxford University in 1979. After qualifying as a solicitor he joined the international banking litigation department of Herbert Smith, solicitors. Trevor joined Bird & Bird as a partner in 1995, and became joint head of the London litigation department the following year and head of litigation for the whole firm in 2001.
   
   Trevor is qualified as a UK solicitor, is a CEDR accredited Mediator, and has also been called to the Israeli Bar.
   
   He has advised extensively on banking law, including OTC derivatives, other complex financial instruments , SFA and SFO investigations. Trevor has a wide experience of acting for clients within the IT and telecoms sectors, including suppliers, manufacturers and users. He has advised on regulatory matters and on a wide variety of commercial disputes including fraud, breach of warranty, product liability and claims under insurance contracts.
   
   Trevor has worked in a variety of UK courts, various arbitration courts, and, in conjunction with local lawyers, in a number of jurisdictions around the world. Trevor has spearheaded the Bird & Bird Mediation Group, and has himself participated in a number of mediations.
   
   Trevor's clients include sovereign states, UK government agencies, major multinational companies and a variety of other corporations and individuals both in the UK and internationally.
   
   Trevor is recognised in directories as a commercial litigation expert, frequently appears in the media, and has lectured and written widely. He has acted in a number of reported cases.

   If clear health risks are ever demonstrated at a later stage, the manufacturer will take ultimate responsibility in the event that an unsafe phone reaches the market, said Trevor Asserson, litigation partner at law firm Bird and Bird, London.
   
   But under the U.K. Consumer Protection Act 1987, and the European Community's Product Liability Directive, manufacturers are covered by the "state of the art" defense, Asserson said. This states that manufacturers will only be liable if they have failed to keep up with known scientific and technical findings at the time the phone was distributed.
   
   However, they would be liable if their phones merely kept pace with formal regulations, as these may take several months to change after new scientific papers are published, he added.
   
   Employers worried about distributing phones to their staff should ensure the devices are issued in their original packaging where possible, Asserson suggested.
