Suzanne Askew, a board member for Scenic Tennessee, said many other types of nonconforming uses have been created when zoning laws are changed.

If Brittenum's interpretation is correct, Askew said it will be difficult to ever phase undesirable land uses - like hourly rate motels - out of city neighborhoods.

"It seems to me we'd be throwing open the door for all kinds of things we've taken care of to come up again," Askew said.

The Planning and Zoning Committee meeting is scheduled to begin today at 1:30 p.m. in the council's conference room on the fifth floor of City Hall.
