Saeed Ali, a spokesman for Polanco, said that his office did not consult with the INS when the bill was being drafted.
He said there was no reason to do so, and he compared such an action to consulting the U.S. Department of Agriculture when writing a law pertaining to a California forestry issue.
"We do sort of a broad check of U.S. law," he said.SB 804 is "legal," Ali said.
He acknowledged, however, that illegal immigrants can be deported if they make themselves known to the INS when applying for residency.
He said he doubts the INS would automatically deport those applying to change their immigration status.
It has been reported that there are an estimated 3 million illegal immigrants in California.

Ali, with Sen.Palanco's office, said the legislation comes down to one issue: "Has this person filed a complete and full application with the government?"
He said, "We have nothing to do with immigration.All we're looking for is proof that this person has applied to the federal government."
Responding to the INS spokeswoman's comments, he said, "They don't know what they're talking about."
