   Former Jackson Kelly attorney Michael A. Albert was also named a Fellow of the West Virginia Bar Foundation.Having retired from the practice of law, Mr. Albert is Chairperson of the West Virginia Public Service Commission.
   
   In the years since the inception of the West Virginia Bar Foundation Fellows, other Jackson Kelly attorneys have been named Fellows.

   Albert was appointed in February 2007 to an unexpired term that ended June 30.He was reappointed to a six-year term that expires June 30, 2013.Prior to joining the PSC, Albert was a member in the Business Law Department of Jackson Kelly, focusing on public utilities and business and commercial transactions.He received a bachelor's degree in business administration from West Virginia University in 1965 and was an officer in the U.S. Navy from 1965 to 1968, including a tour of duty in Vietnam.He received his law degree from WVU's College of Law in 1972, and he is admitted to the West Virginia Bar.

   PSC Chairman Michael A. Albert voted against the geographical split and filed a separate dissenting opinion.He lays out clearly why an overlay system would be much, much better than a geographic split and why a geographic split is the wrong choice.We would urge you to read his opinion.It is can be found on the PSC's Web site.
   
   Albert points out that AT&T as well as other carriers in West Virginia recommended the overlay system, in which existing telephone numbers would retain the 304 code while all new numbers would be assigned the new code; that the PSC's own working group appointed to study the issue recommended the overlay system; that the PSC's attorney recommended the overlay system; that since 2000, 15 states, Puerto Rico, Canada and the Dominican Republic have picked the overlay system; that in July 2007, Utah reversed its decision to go with a geographical split and instead use the overlay system as well as many more valid reasons why he voted against the geographic division.
