    The Union Ministry of Commerce and Industry is disappointed over the lack of feedback and response from the legal community to the proposed reforms in India's patent law aimed at reducing the inordinate delays in processing of patent applications, according to A. E. Ahmad, Joint Secretary (Patents), Department of Industrial Policy and Promotion.

    The patenting community, including corporates, patent agents (attorneys) and inventors should take note of the fact that some of the proposed changes (being discussed in seminars and not officially announced) will be of a substantial character, he said, addressing a meeting on Monday on the amendments to the Patents Act 1970 (enacted last year and enforced this year).

    Mr. Ahmad called attention in particular to a proposal to do away with the provision for pre-grant hearing of opposition to patent applications by third parties, after the Controller "accepts" the patent application and comes to a positive conclusion on its eligibility to grant of a patent. (Opposition provisions after the acceptance stage are governed by Chapter V of the Patents Act). He said there was no unanimity on the issue within the government or patenting circles and there were those who felt that some safeguards would have to be retained. For instance, it had been suggested that the Controller of Patents should have the discretion to "assess" views expressed by third parties while deciding on the grant of patent to an applicant. In many countries, pre-grant hearing was not in existence, he pointed out.

    Mr. Ahmad said the question whether the patent applicant should be charged a higher and differential fee in case his claims in the specification exceeded ten in number was under active consideration. Another proposal related to the launch of a Patent Journal on the lines of the Trade Marks Journal to replace the statutory publication of patent documents and details in the Central Government gazette and abolition of the Patent Inspection Centres in view of the proposed online posting of patent documents, he said.

    May 16: The Union Government plans to set up a new industrial design office in the next two years in view of design industry gaining strong relevance globally, A.E. Ahmad, joint secretary of the Department of Industrial Policy and Promotion, said today. A completely new office dedicated to industrial designs will be opened, which will provide a new groundswell of industrial design activity in the country, he said at a seminar on "innovation through design and opportunities for industries", organised by FICCI. PTI, based on a FICCI release, quoted him saying, "We will be reworking and re-engineering the entire framework of designs and make it a user-friendly design office."
