A number of years ago, the Attorney General's Office issued a "departmental memorandum" to then-State Superintendent Walter Talbot (November 23, 1977) that advised that "a private school means a school operated by private interests as a substitute for, and giving the equivalent of, instruction required in public schools."

We base this policy in part on a letter written by former State Superintendent Walter Talbot in which he said that the issue is not the "relative quality of education in a private school" but a showing of "good faith" on the part of those involved in the school in doing what the law requires. (See Mr. Talbot's letter.) We also base the policy on the substance and spirit of the Attorney General's October 1986 Formal Opinion on home schools.
