Former prison guard tells a judge he now knows how badly he hurt family and friends. A judge placed former Idaho Department of Correction officer Timothy Gilligan on probation earlier this week after he served only a few months of a three-year prison sentence that stemmed from an incident in which he had sex with a female inmate. Timothy Gilligan, well known to Treasure Valley residents as a member of the Boise State football team early this decade, was originally charged in March 2009 with two counts of sexual contact with an inmate, which occurred while he was an IDOC officer in 2007. That charge was eventually changed to burglary - a crime technically committed when someone enters a building with the intent to commit a felony - as part of a plea agreement with Ada County prosecutors in October. At the time, prosecutors told Fourth District Judge Ronald Wilper that the female inmate did not want Gilligan to be charged with a sexual offense because their attraction was mutual. As part of the plea deal, prosecutors recommended Gilligan spend up to 120 days in jail and five years on probation. Wilper disagreed - exceeding the plea deal and sentencing Gilligan to three years in prison and saying he couldn't ask for parole for a year. Wilper told Gilligan his job as an IDOC guard required him to be held to highest standard of integrity and that Gilligan violated public trust. Gilligan and his lawyer, Jon Cox, filed a motion in December to reduce the sentence back to probation, citing Gilligan's positive response to sex offender and cognitive self-change classes. That motion also included several letters written by Gilligan's family and friends asking for leniency and a letter from Gilligan himself, who expressed remorse about how badly he hurt his family - and his victim. He also detailed to Wilper how treatment was helping him understand the gravity of his mistakes and how badly he missed being around his son. "Through all of this I have learned how selfish I have been and how everything had to be 'my way,' " Gilligan wrote. Gilligan, a 29-year-old Boise resident, was a wide receiver for the Boise State football team between 2000 and 2003 and played for a short period of time in the Canadian Football League. Gilligan no longer worked for the IDOC when detectives began investigating the case in December 2008, after the inmate told a prison employee that she had sexual contact with Gilligan three times in 2007 while she was in an inmate worker program. Timothy Ryan Gilligan, a former guard with the Idaho Department of Correction, is set to begin a jury trial in September after pleading not guilty earlier this week to a charge of having sexual contact with a female inmate.
The charges stem from a series of incidents that occurred in April 2007, when Gilligan was working in the maximum security prison, according to Ada County Sheriff's reports. Gilligan, 28, of Boise, was a wide receiver for the Boise State football team between 2000 and 2003 and also played for a short period of time in the Canadian Football League.
