Step 1: To obtain your brokerage license you must file Form OP-1 with the Federal Motor Carrier Safety Administration (FMCSA) which requires a $300 filing fee. TIA's New Broker Kit has everything you need to get started. It contains the required FMCSA forms, plus modal contracts, TIA's fact filled Transportation Broker's Manual, a TIA Membership Directory, and information about membership. As a new service, TIA will file your BOC-3 (processing agents).
Step 2: If your license is granted, you will be required to within 60-days of receiving your MC# from FMCSA a broker must obtain a surety bond or trust fund from a bank or bonding company. The cost varies depending on your personal credit. You are required to carry a $10,000 bond or trust. The form filed with this is BMC-84 or BMC-85. Step 3: All broker applicants must designate a process agent in each State in which offices are located and in which contracts will be written. Process agents who will accept legal filings on applicant's behalf are designated on FMCSA Form BOC-3. Form BOC-3 must be filed within 90 days after the date notice of the application is published in the FMCSA Register. TIA has an agreement with the American Moving and Storage Association to file BOC-3. Please contact a TIA staff member to obtain the form. Public Policy The Office of Public Policy is responsible for promoting TIA's legislative and regulatory agenda on Capitol Hill, with the US Presidential Administration and in the various state capitals around the nation. Public Policy positions are developed through the standing Legislative Committee, composed of TIA members involved in the political process with membership in other trade associations and who have a multi-modal view. Brokers, forwarders and motor carriers should not be required to reveal their margins as required by the "Trust in Reliable Understanding of Consumer Costs Act" (TRUCC Act). In no other industry are businesses required to disclose their profit margins to vendors or customers. The TRUCC Act will open new avenues for class actions lawsuits against brokers, forwarders and carriers. Fuel surcharge legislation is not necessary as brokers, forwarders and motor carriers are collecting and passing along fuel surcharges. No one is profiting from fuel surcharges. TIA's staff and lobbying firm have been very aggressive on Capitol Hill voicing our concern over H.R. 5658 and educating Members of Congress and their staff on what this legislation would do to the brokerage industry. What we found was that there was a common interest between the organizations to find solutions to shared problems of marketplace fraud. TIA Endorses ATA Policy on Privatization of Toll Facilities TIA has endorsed the American Trucking Associations (ATA) policy on privatization of toll facilities. According to the policy, TIA opposes the lease or sale of toll roads, bridges or tunnels to private parties for the purpose of funding highway infrastructure. TIA Joins Truckers in Opposition to LA/Long Beach Air Plan TIA has joined the Harbor Truckers for Sustainable Future to oppose the San Pedro Bay Clean Air Action Plan that was adopted by the Ports of Los Angeles and Long Beach in November 2006. On August 27, 2007, TIA submitted comments to the Federal Maritime Commission regarding the amendment to regulation governing the filing of proof of financial responsibility. On Friday, June 15, 2007, TIA celebrated a victory as Texas Governor Rick Perry (R) signed into law HB 3928, the technical corrections bill to the new state franchise tax (margin tax). The much longer and more complicated language in the draft circulated last spring by Surface Deployment and Distribution Command (SDDC) to TIA for comment prior to publication would have required disclosure of the amount of the surcharge on every shipment, prescribed payment terms and imposed complex allocation and accounting on loads carried by more than one carrier. The TIA government freight committee put together a letter that TIA sent to SDDC objecting to the draft language as unworkable and unsupported by the statute. This is an important accomplishment for TIA, due in large part to the strong working relationship the committee and TIA staff has forged with Jim Gilmore and his colleagues at SDDC.
