According to Kim, the changes were related to streamlining existing rules for approvals, registrations, and filings related to cross-border security/guarantee agreements and other administrative enforcements.
The moves are certainly long overdue, but in the final assessment, Kim says factors need to simply do their job well, no matter the outside forces. While there are additional and different types of risks when you consider cross-border receivables financing, the same underwriting applies. "In the final analysis, the fundamentals of credit do not change, no matter where the transaction is handled," she adds. "The overall underwriting and due diligence process will be the cornerstone of one's decision-making, no matter the deal. It's also important to have foot soldiers on the ground. Kim notes, "In the case of cross-border transactions, it is paramount that the lender or credit granter make themselves well aware of the corresponding country's legal, regulatory, and political climate and have access to professionals in countries where they enact business."
The intricacies help explain some of the reasons behind the global financing trade gap. And there's also the looming threat of financial crimes. "As long as there are money laundering, international con games and the ever-present issue of terror-related financing, financial institutions are apt to err on the side of caution and therefore 'pass' even on very legitimate transactions," says Kim. Fortunately, factors are designed to do the deep due diligence required to weed through complicated transactions. "Factors, especially the independents, tend to be more nimble and less bureaucratic," she adds.
