Steve Bartzak of the West Amwell Police Department, after smaller pieces of the limb broke off on the way down and hit her, causing her injuries.Lt. Bartzak said he hadn't seen Mrs. Taylor's autopsy report this week, but he did see her body after the accident."It seemed to be severe trauma of the upper back," Lt.Bartzak said, describing her injuries.The tree has since been cut down, and the lot appears to be safe, Lt.Bartzak said.He added responsibility for the tree, which previously had been damaged in another fatal accident involving two trucks in August 1999, had not been determined.There had been a fire in that first accident three years ago that killed one of the truckers, a father of three from Warren County, and the tree was blackened from it, according to Lt.Bartzak."It wasn't part of the investigation, and we really didn't make a determination on who actually owned the tree," Lt.Bartzak said."I know there's a certain amount of right-of-way.Just out of concern on the day that it (the second fatal accident) occurred, I sent a patrolman up to speak to either the relatives of the owner (of the flea market) or someone who was familiar with the owner, that the tree should come down."The Department of Transportation since then has followed through on the removal of the tree, he said."It is my understanding that the state Department of Transportation has taken the tree down," Lt.Bartzak said.The incident occurred at about 11:30 a.m. Sept. 11 at the flea market in West Amwell, right in the middle of a period of high wind that hit the area from 10 a.m. to 3 p.m. that afternoon, as reported by the National Weather Service.The winds were the result of a weather pattern that had Hurricane Gustav, off the Atlantic Coast, coming in contact with a high pressure area moving east from the Great Lakes."It was very evident the tree had to be removed," Lt.Bartzak said."It was removed.As far as the other trees (on the parking lot), I don't know."Lt. Bartzak said the state DOT examined the rest of the trees in the lot to check for problems with them."I'm sure they did," he said. ©Packet Online 2002
