ANI requests seizure of EUR 4 M of ex-PSD Senator Serban Bradisteanu's wealth
Bucharest Court of Appeal was notified a second time yesterday in the case of Dr. Serban Bradisteanu
.The petition was filed by the National Integrity Agency
that wants approximately EUR 4 M of the former PSD Senator's wealth to be confiscated.
published in issue 4269 page 2 at 2008-09-16Dr. Serban Bradisteanu, head of ward at the Floreasca Emergency Hospital, was referred to court by the DNA prosecutors on March 22, 2007 on charge of bribery. He
allegedly accepted almost EUR 4 M from a company distributing medical goods, and promised to help the company be awarded various contracts by tendering procedures.
The petition filed by ANI
yesterday is about the manner in which the former MP had obtained the money following a tendering procedure organised by the Ministry of Justice for the procurement of medical equipment. The National Integrity Agency
(ANI) asked the competent court to order the seizure of EUR 3.6 M and of another USD 500,000 of Dr. Bradisteanu's
money. The amounts are believed to have been unduly obtained by the reputed surgeon in 2000 - 2004 when he was a Member of Parliament.
Conflict of interests ANI also informs in a press release issued yesterday that 'a conflict of interests has been also determined in respect of the procurement of medical equipment, procedure in which Bradisteanu was the president of a tendering commission.'
Originally, the National Anti-corruption Directorate (DNA) - who, last year, referred Bradisteanu to court - had filed a petition with the Court of Appeal if Bucharest about the alleged fraudulent way in which the doctor had obtained the large sum. After the National Integrity Agency
(ANI) had been set up, Dr, Bradisteanu's solicitors - one being a member of the National Integrity Council
- asked the court that their client's wealth be checked by the integrity inspectors. All the paperwork was sent to ANI
This is the first case ANI
has sent to court. The agency presents the court the way in which Bradisteanu unjustifiably obtained 'wealth that exceeds his lawful income' because the integrity inspection determined a 'clear inconsistency' in the amounts obtained by Bradisteanu, 'unjustifiably obtained by action in his capacity as the president of the tendering commission set up for the procurement of top technology medical equipment for healthcare establishments belonging to the network of the National Prison Directorate and for the 'Prof.Dr. Constantin Angelescu' Hospital
, both reporting to the Ministry of Justice'.In that capacity - the ANI official findings sent to the Civil Department of the Court of Appeal of Bucharest
called to decide whether or not the ex-Senator's wealth should be seized or not, further read - Bradisteanu
repeatedly overstepped the boundaries of his
competence in the pursuit of economic gain.
At the same time, the National Integrity Agency
also asks the court to declare null and void and rescind the procurement contract in the value of EUR 11,385,889.58 as well as any material benefits generated by it.
On May 4, 2006, DNA prosecuted the members of the tendering commission including Dr. Serban Bradisteanu
