CROWN POINT | Lake County Criminal Court Judge Samuel Cappas on Thursday sentenced a Hammond woman to a 10-year prison term without any suspension of that sentence after a jury found her guilty in February of two Class B felony counts of neglect of a dependent.
Stokes continued to protect her boyfriend during the child's medical treatment and even through her trial and sentencing, Cappas pointed out. However, in sentencing Stokes, Cappas said her behavior wasn't what is expected of a mother. Thank God there wasn't a 2-by-4 behind there," Cappas said. "She covered up what happened. Her actions worked toward covering him (the boyfriend) up rather than her duties of seeking medical care," he said. "If she has a motherly instinct, it's not up to par with what I would expect from the average person," Cappas said prior to sentencing.

Following graduation from Indiana University with a Bachelors degree in Chemistry and Biology, Sam attended Valparaiso University School of Law and received his Juris Doctor degree in 1986. Sam then went to work in the Lake County Prosecutor's Office, working as a Deputy Prosecuting Attorney in the misdemeanor division. After one year, he was assigned to the felony division where he spent the next three years as a felony trial attorney. For two of the three years he spent in the felony division, he tried more jury trials than anyone else in the Prosecutor's Office. During his fifth year, Sam was promoted to Trial Supervisor. In addition to his many assignments, he was responsible for reviewing cases, assigning cases, and overseeing the trial attorneys at trial. He did this for a year before going into private practice. In 1991, he joined a private law firm in East Chicago, Indiana where he engaged in the general practice of law. In 1992, he was selected by the Indiana Supreme Court to sit as "Judge Pro Tempore" for an open county court judge position. Sam presided as judge for half a year until a replacement was selected. He then returned to the law firm until 1994, when he opened his own law firm in Highland, Indiana, focusing on personal injury cases and criminal defense. Cappas & Associates continues to emphasize these areas of law. Sam is a member of the Lake County Criminal Defense Bar Association, American Trial Lawyers Association (ATLA), Lake County Bar Association, and the Indiana Trial Lawyers Association (ITLA). Mike Pence has named veteran criminal defense attorney Sam Cappas to the Lake County Criminal Court bench.
"Sam Cappas has the legal skills and background necessary to serve the people of Lake County as well as Lake Superior Court judge," Pence stated in today's announcement. "It took me by complete surprise," Cappas said of the governor's 1 p.m. telephone call. "He very graciously offered me the job, and I accepted," Cappas said. "I'm very flattered and humbled." Cappas said the timeframe of his taking the bench will be worked out next week between him and the governor's office. Cappas said he anticipates closing his Highland practice, where he is the sole owner, within a couple of months. Besides his private practice, Cappas, 52, has nearly 20 years experience as a public defender, five years as a deputy prosecuting attorney with the Lake County prosecutor's office and one year as permanent judge pro tempore. "Sam Cappas will make an excellent judge," said Judge Thomas Stefaniak Jr., who will vacate the Lake Criminal Court bench to take the Lake Juvenile Court seat. Cappas was one of three finalists of 11 candidates who had sought the position. Cappas, a Cedar Lake resident, is married and the father of 6-year-old twin girls.
