The Sunyani High Court Tuesday struck out a motion on notice that sought to restrain a Deputy Commissioner of Police
, Mr Robert Ayalingo
, from holding himself up as the Brong Ahafo
Regional Police Commander.
A resident of Odumase, near Sunyani, Mr Kwame Baffoe, had prayed the court for an order of interlocutory injunction to restrain Mr Ayalingo
from styling or holding himself up as the Brong Ahafo
Commander until the final determination of a suit against his continued stay in office.
In the substantive case, Mr Baffoe avers that Mr Ayalingo
cannot hold himself up as the regional commander, having attained the compulsory retirement age.
In his statement of claim, the applicant said Mr Ayalingo, until September 3, 2012, was the regional commander and that after attaining the statutory retiring age, his engagement with the Ghana Police Service officially came to an end.
It said upon his
retirement, the respondent was asked to hand over to his
second-in-command but he
refused and subsequently manoeuvred and was given a year's contract extension.
