At the time, Tamisiea argued at length with Rob Klimisch, the Yankton County state's attorney, that the county does not have the authority outlined in the amendment.

Initially, commissioners suggested the issue be held for discussion at their next meeting when Klimisch would be present.However, when he turned up at the commission chambers later on, Tamisiea insisted on reviving the topic.
"I don't want to argue with you here.This isn't the place or the time," Klimisch told Tamisiea.
Klimisch defended the amendment's legality before the commission during its hearing process last month.
Prior to discussion of the amendment, Klimisch inquired whether the commission wanted to have an executive session to discuss the North Hill decision.
Klimisch advised that, because of some time-sensitive issues, the commission should meet with Deibert next week.
"I think you guys should address where you want to go with this in the future," he said.
