AUSTIN, TEXAS (September 8, 2008) - McGinnis, Lochridge & Kilgore, L.L.P. partner Phillip Schmandt has been elected chair of the City of Austin's Electric Utility Commission. Schmandt was re-appointed to the Commission by Mayor Will Wynn in August 2008 and has served on the Commission since March 2006.
Schmandt also heads the technology practice group at McGinnis, Lochridge & Kilgore, L.L.P. His broad range of experience with corporate transactions in the U.S. and Europe give him detailed knowledge of many issues and areas of law including technology, e-commerce, real estate and energy.

Phillip Schmandt, chairman of Austin's Electric Utility Commission, and Steve Smaha, another member of the advisory panel, agree on most matters but have different takes on that question, at least as it relates to Austin Energy's proposal to cut ties with its coal-fired power plant.
Schmandt does not dispute Smaha's calculations but disagrees with his conclusion. Swapping coal for gas, said Schmandt, an energy lawyer, would not immediately reduce the amount of carbon dioxide rising into the atmosphere, but it could provide a blueprint that eventually leads to such an outcome.
"I think there's real value in showing the country how its 10th-largest municipal electric utility can get off of coal, which is the dirtiest resource out there," Schmandt said.
"We shouldn't be locking ourselves into one particular source," Schmandt said, because although natural gas is now available at historically low prices, if the new drilling techniques turn out to be environmentally damaging or overseas demand spikes, "we could see higher gas prices again."
