Since joining Connell Foley in 1998, Mitchell W. Taraschi has solidified his reputation as a skillful attorney before both state and federal courts with a focus on product liability, construction and complex commercial litigation.
Mr. Taraschi has extensive experience representing businesses both large and small, including numerous Fortune 500 companies. Mr. Taraschi has delivered successful outcomes for clients across a diverse range of industries, from manufacturing companies to private and public works contractors and owners, cosmetics companies, pharmaceutical companies, and banks. He also has substantial experience handling complex cases involving: product liability (including mass tort and children's products); commercial and construction contracts; distributor and supply agreements; breach of fiduciary duties; violations of the Lanham Act/trademark infringement; public bidding; defective construction, delay damages and back charges; and partnership disputes on behalf of a variety of clients. Mr. Taraschi serves as a zealous advocate of and an ardent partner with his clients, as evidenced by remarks made by the General Counsel of a national real estate development and construction firm, in which the work of Mr. Taraschi and his team was described as "the best legal work ... ever seen done," for the company. In August 2011, Mr. Taraschi was a chosen recipient of the New Jersey Law Journal's 2011 "40 Under 40" list. Honorees named to the list are considered top leaders in the state's legal community. Mr. Taraschi is an active member of the Defense Research Institute ("DRI") and Juvenile Products Manufacturer's Association ("JPMA"), currently serving as the New Jersey representative for the JPMA-DRI Joint State Liaison Program. His role as New Jersey's State Liaison is to be a resource for both organizations on developments affecting Children's Products Liability in New Jersey. Since 2011, Mr. Taraschi has authored the New Jersey portion of the DRI Children's Product SLG 50 state compendium. While maintaining a busy practice, Mr. Taraschi currently mentors young associates and serves on the firm's Hiring Committee. He was also instrumental in identifying expansion opportunities to grow the firm's presence by opening an office in the Cherry Hill area. Mr. Taraschi is a member of Phi Beta Kappa, Phi Alpha Theta (History Honor Society) and Pi Sigma Alpha (Political Science Honor Society). He graduated from Lafayette College ranked first in the Government & Law Department, magna cum laude and with honors. He was a member/participant of the Moot Court competition as well as the International Law Society while attending the University of Virginia Law School. Mr. Taraschi also defends claims that the developer made misrepresentations in community public offering statements. Mr. Taraschi successfully obtained a dismissal of many of the homeowner claims pursuant to New Jersey's statute of repose. Representation of a national construction management firm in a multi-million dollar construction case against the New Jersey Schools Development Authority (NJSDA), relating to the design and construction of various schools. Mr. Taraschi was the architect of the defense of this matter where the construction manager was terminated from more than 20 school projects. The case was successfully settled and the termination set aside as a result of the legal strategy employed by Mr. Taraschi. Representation of a residential development against a contractor relating to the deficient installation of approximately 4,000 windows. Mr. Taraschi successfully obtained an arbitration award against the contractor. Representation of public owner relating to the enforceability of a multi-million dollar settlement agreement as well as the termination of its construction manager overseeing the expansion and renovation of seven schools within the Nutley School District. Represented a subcontractor who had a contract in excess of $70,000,000 to build a significant portion of the $500 million Tosco Bayway Refinery Polypropylene Plant Project. The subcontractor had filed a construction lien stating that the contract amount, initially, had been $15,110,000 and that amendments to the contract had come to $56,612,700.86, resulting in a total of $71,722,700.86. Mr. Taraschi litigated the validity and amount of the lien filed by the subcontractor. In his role as Board Member and Chief Administrative Officer of Amenity LLC, Mr. Taraschi has spearheaded Amenity's support for and partnership with charitable organizations, including the Cancer Research Institute and Career Gear. As such, he has earned the title of Charity Director within the company. His involvement includes: reviewing all documentation between charitable organization and Amenity, assisting with charitable events, helping with fundraising efforts, deciding Amenity's role in events (donation, product gift bag "giving," auction items, sponsorship, etc.), and attending events as the representative of the company. In addition, Mr. Taraschi is solely responsible for identifying which charities the company will donate to throughout each calendar year. Mr. Taraschi decides and then communicates directly with each charity. He then prepares what will be donated for each event; gift cards, bags, individual items, etc. Mr. Taraschi has been involved with this role for 5 years. IHM Annual Thanksgiving Food Drive, Mr. Taraschi assists with the organization of the collection of canned and boxed food for a series of 3 weeks prior to Thanksgiving which feeds families from 6 local inner city Roman Catholic Parishes located throughout Union and Somerset Counties.
