Mitchell W. Taraschi joined the firm in 1998 and is a member of the Business Litigation and Construction Law practice groups and practices in both state and federal courts. He focuses much of his practice in the business litigation area and has represented clients from many industries, including private and public works contractors, cosmetic companies, pharmaceutical companies and banks.
Some notable work includes representation of a national bank in a fraud action; representation of personal injury cases; representation of a national health care organization in a trademark ownership dispute; representation of a national homebuilder in an action related to the construction of a high rise condominium complex in Hoboken; representation of a pharmaceutical company in mass tort products liability actions; and representation of a skin care/cosmetics company in the development of operating agreements, product development agreements, international distributorship agreements, sales representative agreements and employment agreements.

Mr. Taraschi successfully obtained a dismissal of many of the homeowner claims pursuant to New Jersey's statute of repose Representation of a national construction management firm in a multi-million dollar construction case against the New Jersey Schools Development Authority (NJSDA), relating to the design and construction of various schools. Mr. Taraschi was the architect of the defense of this matter where the construction manager was terminated from more than 20 school projects. The case was successfully settled and the termination set aside as a result of the legal strategy employed by Mr. Taraschi Representation of a residential development against a contractor relating to the deficient installation of approximately 4,000 windows. Mr. Taraschi successfully obtained an arbitration award against the contractor Representation of public owner relating to the enforceability of a multi-million dollar settlement agreement as well as the termination of its construction manager overseeing the expansion and renovation of seven schools within the Nutley School District Representation of a developer relating to the multi-million dollar foreclosure of two parcels of property to be developed for residential use. Issues addressed in this litigation include whether the seller of the property is permitted to foreclose on the property for failure of purchaser to pay property taxes when the reason the taxes have not been paid is because the seller failed to complete the environmental remediation of the property as required by the contract Represented a subcontractor who had a contract in excess of $70,000,000 to build a significant portion of the $500 million Tosco Bayway Refinery Polypropylene Plant Project. The subcontractor had filed a construction lien stating that the contract amount, initially, had been $15,110,000 and that amendments to the contract had come to $56,612,700.86, resulting in a total of $71,722,700.86. In his role as Board Member and Chief Administrative Officer of Amenity LLC, Mr. Taraschi has spearheaded Amenity's support for and partnership with charitable organizations, including the Cancer Research Institute and Career Gear. As such, he has earned the title of Charity Director within the company.

Mr. Taraschi is responsible for attending bi-monthly meetings and directing, navigating, and assisting the company's management team with major company decisions. Mr. Taraschi also drafts product development agreements, international distributorship agreements, sales representative agreements, and employment agreements. This event assists families from 6 local inner city Roman Catholic Parishes, nursing homes, and mentally challenged living facilities located throughout Union and Somerset Counties. He assists the Chairperson with deciding which parishes to target, orchestrates the announcement of the event, collection, packing, and delivery of items to needy individuals. Mr. Taraschi has been involved with this charity for over 10 years. Contributing Author, a 50-state survey entitled: "Damages Recoverable in a Minor's Personal Injury or Wrongful Death Action," in which Taraschi provided a summary of - and insight into - the types of damages recoverable in New Jersey when a minor is injured or killed. The survey was disseminated at the DRI Products Liability Conference held in Las Vegas.
