Bogin Principal, Sive, Paget & Riesel The residential rezoning of New York's waterfront is a fairly recent phenomenon-and a critical one, if you ask attorney Michael Bogin, who has devoted much of his life to improving waterfront access, even when that meant having to fight city hall. "If you push people back from the water, they'll never appreciate the natural resource there. They will not give their tax dollars," Bogin explained. "It's like the national park system. If you had a national park system in which people were closed out, we wouldn't have any parks. The reason people support them is because they can visit them, enjoy them and appreciate them." Over the last decade, Bogin has led environmental teams on complex residential and commercial waterfront developments in Williamsburg, Greenpoint, Maspeth, Coney Island and Staten Island - as well as the massive Queens West mixed-use housing development in Long Island City. Bogin and his team patiently secured agreements with the state to clean up the Queens West site - formerly occupied by an oil refinery - along with the permits required to create a public park through what he terms a true public-private partnership. "If you don't have a vibrant and resilient waterfront," Bogin said, "you won't have a vibrant and resilient New York." Before he was a waterfront advocate, Bogin worked on environmental issues for the NYC Law Department. He helped revise watershed regulations that had not been updated since World War I, and worked to secure the city's right to litigate outside its boundaries in upstate watershed communities. He worked one of New York's key federal Superfund cases, which eventually established that cities could recover cleanup costs for damage done to their landfills. While with the city, he also tried the first case to enforce the requirements of New York State's Storm Water General Permit under the Clean Water Act, which helped minimize pollutants flowing from construction worksites. A Principal at the environment law firm Sive, Paget & Riesel, Bogin regularly counsels his real estate clients on the importance serving as responsible stewards of the environment. As he sees it, "Working in the private sector doesn't absolve you of your public responsibility."
