The Fountain City Council fired former full time city police officer Melissa Winterfeldt, 27, of Mauston, Wis., in September.Winterfeldt
filed a claim for damages in December, alleging she
was discharged without just cause in violation of her
employment contract with Fountain City.
A two-part claim asked for payment of lost wages and fringe benefits, as well as expenses for finding new employment.
Amounts cited in the December claim included damages owed to Winterfeldt
of ,12,000 in lost wages and benefits, ,2,000 in expenses to find new employment and ,5,000 in attorney fees.
now has the option to file a formal lawsuit and pursue her
case in circuit court.She
has up to 120 days to file suit.
According to the information Hoffmann had from Dillon, more of Winterfeldt's
employment information should have been documented in writing, though city officials say it was clearly understood that Winterfeldt
was still working on probationary status when dismissed.
Hoffmann said the attorney representing the city also had evidence showing that officers employed prior to Winterfeldt
were employed under one-year probationary agreements.
