The parliament's petitions committee, which is due to discuss the charges, will be told by Professor Mark Poustie, of Strathclyde University, that the bridge costs have already been paid off.
Prof Poustie has provided a legal note of his views which will be submitted to the committee by the anti-tolls campaigner Robbie the Pict.
It follows the legal expert's examination of documents controlling the tolls, including the New Roads and Street Works Act 1991 and an assignation statement, which gave permission to the bridge company to charge drivers to make the crossing.
He said the assignation statement indicates the agreed costs of designing and constructing the bridge and toll plaza were £23.64 million at 1990 prices.
He said it is also anticipated that the concession period will not be as long as the 27-year period during which there is authority to charge tolls, but is estimated to be between 14 and 18 years.
