They can plead hardship or challenge the foreclosure paperwork, in an effort to get the deficiency settled, said Margery Golant, of Golant & Golant in Boca Raton, Fla.

"There are all these robotic processes and nobody to make any intelligent business decisions," said attorney Margery Golant, a principal at the law firm Golant & Golant.
"There's just nobody home."

"This situation with GMAC isn't limited to GMAC," Margery Golant, of Golant & Golant, a foreclosure law firm in Boca Raton, Fla., said in an interview with HousingWire.
Golant pointed to a recent case in Florida involving one borrower who was foreclosed on by two different lenders at the same time. Neither could agree on who held the mortgage note. In June, The Florida Attorney General's office launched an investigation into Fidelity National Financial, its former subsidiary Lender Processing Services and LPS subsidiary Docx, alleging the companies used false documents to foreclose on Florida homeowners. "We bring this up in court all the time, and the judges look at us like we're crazy because it's hard for anyone to believe the massiveness of this," Golant said.

“It frustrates me when I see the government looking to the servicer for the solution, because it will never ever happen,” said Margery Golant, a Florida lawyer who defends homeowners against foreclosure and who worked as deputy counsel for a major mortgage company, Ocwen Financial.
Ocwen established its title company, Premium Title Services, in part to keep more of the revenue flowing from foreclosures, said Golant, who was involved in starting the venture. “It was hugely profitable,” she said. “It's under the radar,” Golant said. Ultimately, the benefits of delinquency erode incentives for mortgage companies to dispose of troubled loans quickly, experts say, allowing distressed houses to decay and fall in value – a fact of little interest to the servicer. “At the end of the day, it doesn't matter what the house sells for, because they don't take that loss,” said Golant. “Meanwhile, they are collecting all these fees.”
